An IVA is a formal agreement between you and your creditors. So what is an IVA?
If you owe more than £15,000 an IVA may well be the answer to your debt problems. If you owe less than £15,000 there may be other debt solutions.
- To find out if you qualify for an IVA please complete our simple online questionnaire.
- A sympathetic debt counsellor will contact you in confidence to discuss your application.
- If your debt problems fir our criteria you will be accepted onto our IVA programme and passed to one our debt negotiators.
- The debt negotiator will act on your behalf and contact all your creditors informing them that they are now your legal financial representative. There is no charge for this service.
- An IVA proposal will be draughted, based on your personal financial information. This is a legal, formal agreement that lays out the actual terms of your personal IVA.
- To stop your creditors continuing to harass you, an interim order which is a form of legal protection is granted. This is a legal process affording you full protection from all your creditors.
- Once the Interim Order is granted, your creditors cannot contact you again or take any legal action against you. Having this interim order means you are totally protected from any of your creditors issuing or continuing bankruptcy proceedings.
- The debt negotiator then draws up a Nominees Report, which is a legal statement that describes in their professional opinion that the IVA is a genuine offer of account.
- A meeting of your creditors is arranged shortly afterwards. This meeting is all your creditors gathered together to discuss your IVA. Usually, creditors rarely bother to attend these meetings as all voting has been done prior to the meeting.
- Once your IVA is approved and accepted, you are legally compelled to maintain your monthly IVA payments.
- Once your IVA is accepted, none of your creditors can contact or harass you again.
- Your monthly single payment should be easily affordable as it is based entirely on your disposable income.
